funfacts Terms of Service & EULA

Effective Date: March 2026

These Terms of Service and End User License Agreement ("Terms") govern your use of the mobile application funfacts (Package / Bundle Identifier: com.sirimirilabs.funfacts), developed and provided by sirimiri labs ("we", "us", or "our").

          By downloading, installing, accessing, or using funfacts, you agree to be bound by these Terms. If you do not agree to these Terms, please do not download, access, or use the application.
        

1. License Grant & Intellectual Property

Subject to your compliance with these Terms, sirimiri labs grants you a personal, revocable, non-exclusive, non-transferable, limited license to download, install, and use funfacts solely for your personal, non-commercial educational and entertainment purposes on devices you own or control.

All trademarks, service marks, application visual designs, tactile card animations, typography arrangements, branding, and proprietary software code are the intellectual property of sirimiri labs. You may not copy, modify, distribute, sell, reverse engineer, or decompile any part of funfacts without prior written authorization.

2. Educational Content & Factual Grounding

funfacts is designed to deliver fascinating, peer-reviewed, and curated facts across diverse disciplines (including biology, history, astrophysics, linguistics, and architecture). While facts are grounded in reputable sources, journals, and educational institutions, funfacts is provided for general learning and entertainment purposes only. We make no warranty that all information will be error-free or perpetually complete.

3. Duo Mode & User Conduct

funfacts offers an optional "Duo Mode" allowing two users to link devices using a private 6-character code and share factual discoveries:

Display Names: You agree not to select a display name or nickname that is unlawful, offensive, harassing, defamatory, vulgar, or infringes the rights of any third party.
Lawful Use: You agree to use funfacts only for lawful purposes and not to misuse, disrupt, or attempt unauthorized access to our Firebase backend or network infrastructure.

4. Subscriptions & In-App Purchases (Funfacts Pro)

funfacts offers optional auto-renewing subscriptions and in-app upgrades under Funfacts Pro:

A. Subscription Features

A Funfacts Pro subscription unlocks unlimited daily fact swipes, unlimited permanent archive capacity, the full Stamp Box of reaction seals, and pro-level sharing with your linked duo partner.

B. Billing & Payment

Payment Processing: Payment will be charged to your Apple ID Account (for iOS devices) or your Google Play Account (for Android devices) at confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off or cancelled at least 24 hours before the end of the current billing period.
Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
Free Trials: If a free trial is offered, any unused portion of a free trial period will be forfeited when you purchase a subscription, where applicable.

C. Managing & Cancelling Subscriptions

You can manage or cancel your subscription at any time through your device's account settings:

iOS: Go to iPhone Settings > [Your Name] > Subscriptions, select funfacts, and tap "Cancel Subscription".
Android: Open Google Play Store > Profile icon > Payments & subscriptions > Subscriptions, select funfacts, and tap "Cancel subscription".

D. Restoring Purchases

If you reinstall funfacts or switch to a new device on the same platform and store account, you can restore active subscriptions at any time by tapping the "Restore Purchases" button on the in-app Paywall or in Settings.

E. Refunds

All billing and refund requests are handled directly by the store through which the purchase was made (Apple App Store or Google Play Store), subject to their respective refund policies.

5. Disclaimer of Warranties

FUNFACTS IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SIRIMIRI LABS, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APPLICATION.

7. Account & Data Termination

You may terminate these Terms at any time by uninstalling the application or using the built-in "Delete Account & Data" feature in the app's Settings screen. We reserve the right to suspend or terminate access to duo-pairing or cloud sync services for any user who violates these Terms.

8. Privacy Policy Reference

Your privacy is important to us. Our collection and handling of device data, anonymous identifiers, and purchase status are governed by our Privacy Policy, which is incorporated by reference into these Terms.

9. Changes to Terms

We reserve the right to revise these Terms from time to time. Any changes will be posted on this page with an updated effective date. Continued use of funfacts following posted updates constitutes acceptance of the modified Terms.

11. Apple App Store Additional Terms and Conditions

The following terms apply solely to your use of funfacts on iOS devices downloaded via the Apple App Store:

A. Acknowledgement

You and sirimiri labs acknowledge that these Terms are concluded between you and sirimiri labs only, and not with Apple Inc. ("Apple"). sirimiri labs, not Apple, is solely responsible for funfacts and the content thereof.

B. Scope of License

The license granted to you for funfacts is limited to a non-transferable license to use the application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

C. Maintenance and Support

sirimiri labs is solely responsible for providing any maintenance and support services with respect to funfacts. You and sirimiri labs acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to funfacts.

D. Warranty

In the event of any failure of funfacts to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for funfacts to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to funfacts, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of sirimiri labs.

E. Product Claims

You and sirimiri labs acknowledge that sirimiri labs, not Apple, is responsible for addressing any claims by you or any third party relating to funfacts or your possession and/or use of funfacts, including, but not limited to: (i) product liability claims; (ii) any claim that funfacts fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

F. Intellectual Property Rights

You and sirimiri labs acknowledge that, in the event of any third-party claim that funfacts or your possession and use of funfacts infringes that third party's intellectual property rights, sirimiri labs, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

G. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

H. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using funfacts (e.g., you must not be in violation of your wireless data service agreement when using network features).

I. Third-Party Beneficiary

You and sirimiri labs acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
